Cell phones have become an ever-present part of our lives. They are always within reach, whether at the office, while commuting, or at home. Some of these cell phones are provided by employers for work purposes, while other employers allow their employees to use their own devices. Some employees may have two phones, one for work and one for personal use. Their ubiquity means that the lines between personal and work usage are often blurred. Whether it is making phone calls, texting, tweeting, taking photos, or another activity, the cell phone has a broad range of functions that can raise issues for employers. Are there legal or wage issues when an employee is taking calls or checking work email on a phone outside of normal business hours? What happens when company information ends up on social media, whether accidentally or intentionally? Who owns the data on the device, and does the analysis change if a personal device being used for work purposes is involved? Who is liable for an accident caused by an employee texting while driving a company vehicle? Are there privacy risks surrounding phone-based cameras? Employers must know the answers to these questions, which have been shaped by guidance from the NLRB, EEOC, and other agencies.
