Title IX of the Education Amendments of 1972 (Title IX) extends to protect students from sexual harassment and sexual violence, such as rape, sexual battery, and sexual coercion. In recent years, the Department of Education has provided greater attention to this area and provided important guidance on this issue. After an institution has received a complaint and conducted an investigation into the complaint, the institution must still be aware of other procedures or issues that remain. In particular, although the institution may have completed the investigation, it still must implement the report. In addition, after notifying the parties of the report, the parties may still appeal any findings or seek further complaints with the Department of Education. This presentation will explain the need for institutions to consider these additional procedures within its overall investigation and develop effective policies and procedures to properly address these matters.
