Addressing mental health issues with students has become a very important part of today’s classroom environment. According to one study, nearly fifty percent of children will have a diagnosable mental illness at some point before they turn 18. As a result, school officials often face situations where they need to assist students with suspected mental health concerns, including concerns with anxiety, depression, self-harm, and suicide. In these situations, school officials are most concerned with appropriately and correctly identifying the need for assistance and then getting the student that assistance as soon as possible. However, school officials are also concerned with avoiding any legal issues when helping these students, including issues that may be triggered by referring such students, communicating with others about this student, or protecting that student from harming himself/herself or other students.

  • Discuss legal aspects of formulating and implementing a crisis intervention plan or dealing with a crisis situation

Rick is an experienced member of the School Law Practice Group and the Labor and Employment Group at the firm. He represents educational institutions (including public school districts and technical colleges) in a variety of education law matters. He counsels school clients in labor and employment, student rights, student discipline, meetings and records, special education, Title IX, privacy and technology issues, student safety, policy, governance, and many other issues. Rick regularly provides training on these issues, conducts compliance reviews, attends board meetings, drafts and negotiates contracts, prepares opinions, analyzes legislation and school board policies, and provides other legal services. Rick has also published many articles on education and employment law related topics. In addition, he has participated in seminars and presentations dealing with education, labor, and employment related topics. He is a member of the State Bar of Wisconsin and is the former President of the Wisconsin School Attorneys Association, and is admitted to practice before the Wisconsin Supreme Court and the United States District Court for the Western District of Wisconsin.
