With more than half of the states in the country having legalized medical marijuana in some form, education entities around the county are struggling with how to address the needs of employees who wish to use this new medication. Employees who use medical marijuana can generally be prohibited from using it at work, but many states provides protections to these employees under the state medical marijuana law or under disability discrimination laws that protect the employees from adverse employment action if they are using it outside of work. To further complicate the issue, medical marijuana is still illegal under federal law. Stuck in the middle, educational entities must balance complying with federal law, the rights of employees under state law, and public relation issues related to “drug” use by employees.

Mr. Gilsbach is an attorney with King, Spry, Herman, Freund & Faul, LLC and focuses his practice in the area education law, including student related issued and employment issues. Mr. Gilsbach represents education entities in litigation in these areas, as well as advising clients in efforts to avoiding litigation and in developing policies and procedures.
Mr. Gilsbach is a regular presenter at local and state-wide conferences on various areas of special education law and other areas of education law. He was selected as a Pennsylvania Rising Star in the area of School law 2012 to 2014 and as a Pennsylvania Super Lawyer in the area of school law in 2017. Mr. Gilsbach holds a J.D. degree from the Pennsylvania State University’s Dickinson School of Law and a B.A. degree in political science from Messiah College.
