With more than half of the states in the country having legalized medical marijuana in some form, education entities around the county are struggling with how to address the needs of employees who wish to use this new medication. Employees who use medical marijuana can generally be prohibited from using it at work, but many states provides protections to these employees under the state medical marijuana law or under disability discrimination laws that protect the employees from adverse employment action if they are using it outside of work. To further complicate the issue, medical marijuana is still illegal under federal law. Stuck in the middle, educational entities must balance complying with federal law, the rights of employees under state law, and public relation issues related to “drug” use by employees.

Please join Timothy Gilsbach for a webinar that will help educational institutions understand their rights and risks when it comes to the use of medical marijuana by employees.

Just a sampling of what this webinar will cover:

  • What is permitted and what is not under state medical marijuana laws?
  • What protections do employees have who use medical marijuana?
  • How do we address that this is still illegal under federal law?
  • Does this put federal funding in jeopardy?
  • What steps must school entities as employers take to accommodate medical marijuana users?
  • What other steps should entities take as employers to limit liability for claims by medical marijuana users?
