Title IX and K-12 Athletics: Avoiding Liability

Title IX of the Education Amendments of 1972 (Title IX) prohibits discrimination on the basis of sex in education programs and activities. Although the Act itself does not mention its application to interscholastic athletics, the regulations promulgated in response to Title IX make it clear that these protections extend to athletics. Of course, this law has played an important role in providing equitable opportunity in athletics. However, the application of Title IX can be complicated, and in some cases, issues or violations can be created unknowingly. Because of these complexities, it is important to clearly understand the scope and application of Title IX to athletics in order to ensure compliance.
